1. Acceptance of Terms

By accessing and using Barney Court ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Entertainment Purposes Only

Barney Court is provided for entertainment purposes only. The Service is not a real legal service, does not provide legal advice, and does not create any attorney-client relationship. Any cases submitted through the Service are fictional and for entertainment purposes only. The Service does not file actual legal cases, and no legal proceedings will be initiated as a result of using this Service.

3. User Accounts and Registration

You may be required to create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Payment Terms

The Service charges a fee of $35 for case submissions. All payments are processed through Stripe. By making a payment, you agree to Stripe's terms of service. All fees are non-refundable unless otherwise required by law. The Service reserves the right to change pricing at any time, but changes will not affect cases already submitted.

5. User Content and Conduct

You are solely responsible for any content you submit through the Service. You agree not to submit content that:

  • Is illegal, harmful, threatening, abusive, or defamatory
  • Violates any third party's rights, including intellectual property rights
  • Contains personal information of others without their consent
  • Is spam, fraudulent, or misleading
  • Attempts to impersonate another person or entity

6. AI-Generated Content

The Service uses artificial intelligence to generate case summaries, judgments, and other content. All AI-generated content is for entertainment purposes only and should not be relied upon for any legal, financial, or other professional advice. The Service makes no warranties regarding the accuracy, completeness, or reliability of AI-generated content.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Barney Court and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of the Service without our express written permission.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BARNEY COURT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Indemnification

You agree to indemnify and hold harmless Barney Court, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to your use of the Service, your violation of these Terms, or your violation of any rights of another.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Barney Court operates, without regard to its conflict of law provisions.

14. SMS Text Messaging Terms

By opting in to receive SMS text messages from Barney Court, you agree to the following terms:

14.1 Consent to Receive SMS

When you check the SMS opt-in checkbox during case submission, you explicitly consent to receive SMS text messages from Barney Court at the phone number you provide. This consent is not a condition of purchase or use of the Service.

14.2 Message Types

You may receive SMS messages for the following purposes:

  • Case submission confirmations
  • Case status updates and notifications
  • Important information about your case

Message frequency varies but typically does not exceed 1-3 messages per case submission.

14.3 Opt-out Rights

You may opt out of receiving SMS messages at any time by replying to any message with one of the following keywords: STOP, STOPALL, UNSUBSCRIBE, or QUIT. After opting out, you will receive a confirmation message and will no longer receive SMS messages from Barney Court.

You may opt back in at any time by replying START, YES, or UNSTOP to any message, or by checking the opt-in box when submitting a new case.

14.4 Message and Data Rates

Message and data rates may apply according to your mobile carrier's plan. Barney Court is not responsible for any charges incurred from your mobile carrier for receiving SMS messages. Standard message and data rates apply.

14.5 Carrier Support

Not all mobile carriers support SMS messaging. Barney Court is not responsible for message delivery failures due to carrier limitations or restrictions. If you are unsure whether your carrier supports SMS, please contact your carrier directly.

14.6 Phone Number Changes

If you change your phone number, you must update your contact information in your account or opt out from your old number and opt in with your new number. Barney Court is not responsible for messages sent to an incorrect or outdated phone number.

14.7 Third-Party Service Provider

SMS messages are delivered through Twilio, a third-party service provider. By using our SMS service, you acknowledge that your phone number and message content may be shared with Twilio for the purpose of message delivery. Barney Court is not responsible for any actions or omissions of third-party service providers.
